As from 1 March 2012, every person that sells any food product must ensure that the labels of the products being sold, is in compliance. As stated in the Consumer Protection Act, it is clear that the seller of products can be as liable as the manufacturer. It is therefore in the seller’s best interest to follow due diligence and ensure that they only accept food products with the correct labelling. |

Consumer Protection Act With the Consumer Protection Act now in place and with the Regulations Relating to the Labeling and Advertising of Foodstuffs coming into affect on 1 March 2012, South African food consumers have gained more rights than ever before. Not only do they have more rights to information about what they consume, but they also have easier paths for recourse should the consumer suffer any illness or damage as a result of their purchase. All food importers, manufacturers, retailers and the hospitality services must not only ensure that they present accurate information regarding their products, but that it is also presented in the correct manner. The CPA and Regulation 146 place significant emphasis on possible repercussions should misleading and false information be provided or statements be made. |
